How have you obtained some of your information relating to your spouse’s finances. By chance? By improper means? Beware as this case has changed the way such information can be used in Court proceedings by you or your Solicitor. You may say you have done no wrong as it is your spouse who has failed to provide full and frank disclosure pursuant to the rules. The Court may decide not to permit such information/documents being used in support of your case thereby leaving you without any way of proving asset ownership or monies in hidden bank accounts. Will this lead to unfair settlements as a party gets away with not disclosing all?
